A U.S. judge dismissed antitrust lawsuits filed against Google by Chegg and Penske Media, ruling the plaintiffs failed to meet federal legal requirements despite acknowledging harm to publishers from Google’s content practices.
Judge Amit Mehta’s decision noted that publishers and their employees are suffering harm from Google repurposing content without compensation, but the dismissal was based on the plaintiffs’ inability to satisfy federal antitrust law stipulations, not a finding of an absence of harm.
The court rejected five distinct categories of claims brought by Chegg and Penske Media, including reciprocal dealing, tying, unlawful monopoly maintenance, attempted monopolization and monopoly leveraging, and unjust enrichment.
Claims related to reciprocal dealing failed due to a lack of plausible evidence demonstrating an actual agreement between Google and the publishers, according to court documents.
The plaintiffs also lacked standing to challenge Google’s alleged monopoly maintenance and did not define plausible markets for their attempted monopolization claims, Judge Mehta stated in the ruling.
California unjust enrichment claims were subsequently dismissed after all federal claims against Google were rejected by the court.
The lawsuits had accused Google of engaging in anti-competitive practices that disadvantaged publishers and content creators by leveraging its dominant position in online search and advertising markets.
Google has consistently denied allegations of anti-competitive behavior, stating its practices benefit both users and content providers by connecting them efficiently.
