BRUSSELS — The European Commission’s Article 50 of the AI Act, mandating transparency for AI-generated content, came into force across the European Union, requiring disclosure for content accessible within the bloc regardless of its origin.
The new regulation introduces four key exemptions to this labeling requirement, alongside several ambiguities that could significantly affect content publishers and AI developers operating in the region.
One exemption applies to artistic and satirical deepfakes, allowing for reduced disclosure if the AI-generated content is “evidently” artistic, creative, satirical, fictional or analogous, according to the European Commission.
Another exception covers publishers where AI-generated text for public interest content undergoes human editorial review before publication.
The standard editing and assistive tool exemption applies to AI systems that offer assistive functions for routine editing or do not substantially alter input data.
Furthermore, an “obvious use” exemption for interactive AI systems waives disclosure requirements when it is clear that a person is interacting with an AI system.
Despite these exemptions, the European Commission acknowledged that significant ambiguities remain within the new rules.
These include undefined terms such as “evidently artistic,” “appropriate manner,” “human review,” “public interest,” “substantially alters,” and “obvious use,” which could lead to varied interpretations and compliance challenges.
The implementation of Article 50 aims to enhance user awareness regarding AI-generated content, but its practical application will depend on how these nuanced definitions are interpreted and enforced.
